The Council of the Order determines the number of assistant pharmacists that can be hired by the owners of the pharmacy because of the importance of their turnover.
Any person holding the professional diploma referred to in this law or an equivalent diploma is qualified as a pharmacy assistant or a technician in pharmaceutical science.
Any pharmacist may be assisted in his pharmacy by several pharmacy assistants or technicians in pharmaceutical science.
By way of derogation from the provisions of the preceding paragraph, the persons regularly registered on a list drawn up by the authority responsible for public health before 1968, may continue to exercise this function with the rights, prerogatives, and charges which are attached to it.
The creation and operation of courses for the preparation of the professional diploma as well as the programs and the exams for its awarding shall be determined by a joint act of the authorities responsible for Public Health and Higher Education, after the opinion of a commission composed as follows:
1 – representative of the authority responsible for Public Health ;
1- representative of the authority responsible for higher education
1- representative of the Council of the Order of Pharmacists;
1 – representative of the pharmacists;
1- representative of the Pharmacists’ Union.
The pharmacy preparers or technicians in pharmaceutical science are,
under the responsibility and effective control of a pharmacist, entitled to prepare medicines in all forms, to handle toxic and narcotic drugs, and more generally all products intended for the treatment of human diseases. They are criminally responsible for their actions.
Pharmacy assistants or technicians in pharmaceutical science cannot, under any circumstances, replace the pharmacist in terms of the prerogatives attached to the pharmacist’s diploma and the ownership of the pharmacies.
Trainees and students in pharmacy are authorized to carry out the operations provided above under the conditions set by the authority responsible for Public Health. This authorization also determines the conditions under which these students may benefit from the above provisions after having passed the examination for the award of the professional diploma.
Except for the exceptions provided for in this law, no one who does not meet the conditions set out above, may not avail himself of the status of pharmacy assistant, nor on the professional level, use the rights and prerogatives attached to this status, under penalties provided for in article 250 of the Penal Code.
In the event of a repeat offense, the penalty is doubled.
The provisions of the present article do not apply to pharmacy students, nor to trainees who can be employed in a pharmacy under the conditions provided for in this law.
