According to Law N° 88-022 of 16 December 1988 modifying certain provisions of law N° 84-09 of 5 December 1984 regulating the practice of the profession of nurse, midwife, and medical-sanitary technician, Is found guilty of illegal practice of the profession of a midwife, nurse or medico-sanitary technician:
Any nurse, midwife, or medical-health technician who exercises his or her activity under a pseudonym or who provides services in commercial premises where equipment used by them is sold or prescribed.
Any unauthorized person who, even in the presence of a professional
(nurse, midwife, medical/health technician), usually takes part in the provision of care.
Any professional who carries out his activity is in violation of the provisions of Article 2 of the law.
Any professional who carries out his activity in spite of a temporary or definitive ban of which he is the subject.
The provisions above shall not apply to assistant nurses, nursing assistants or assistant nurses, holders of diplomas or titles recognized by the State, student nurses, student midwives, student medical and health technicians who act either under the effective supervision of a doctor or under that of a qualified professional of the
body concerned.
